Terms of Service

1. Acceptance of Terms

By downloading, installing, or using POP Remote ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and POP Remote ("we," "us," or "our") regarding your use of the App and related services.

2. Description of Service

POP Remote is a multi-protocol remote desktop client for Android that enables users to:

  • Connect to remote computers using RDP (Remote Desktop Protocol) and VNC (Virtual Network Computing)
  • Control remote computers through touch interface
  • Utilize AI-powered automation for remote tasks (subscription features)
  • Use voice control features for remote commands (Premium subscription only)
  • Save and manage multiple connection bookmarks

3. Eligibility

You must be at least 13 years old to use POP Remote. By using the App, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will use the App in compliance with these Terms and all applicable laws
  • All information you provide is accurate and current

4. User Accounts

4.1 Account Creation

  • You may use POP Remote with or without creating an account
  • AI features require sign-in with a Google account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account

4.2 Account Security

  • You must notify us immediately of any unauthorized access to your account
  • We are not liable for losses caused by unauthorized use of your account
  • You may not share your account credentials with others
  • You may not use another person's account without permission

5. Subscription Plans and Billing

5.1 Subscription Tiers

POP Remote offers three subscription tiers:

  • FREE: €0/month - Unlimited RDP/VNC connections, 2 AI tasks per week
  • BASIC: €4/month - All FREE features, 10 AI tasks per week
  • PREMIUM: €8/month - All BASIC features, 20 AI tasks per week, 10 voice tasks per week, voice control features

5.2 Billing and Payments

  • Subscriptions are billed monthly through Google Play Store
  • Payment is charged to your Google Play account upon purchase confirmation
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Account will be charged for renewal within 24 hours prior to the end of the current period
  • Prices are subject to change with 30 days notice

5.3 Weekly Usage Quotas

  • AI task quotas reset every Monday at 00:00 UTC
  • Unused tasks do not roll over to the next week
  • When quota is exceeded, you will be prompted to upgrade to a higher tier
  • Quota changes take effect immediately upon subscription tier change

5.4 Cancellation and Refunds

  • You may cancel your subscription at any time through Google Play Store
  • Cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial months
  • Refund requests must be submitted through Google Play Store according to their refund policy
  • We reserve the right to issue refunds at our sole discretion

6. Acceptable Use

6.1 Permitted Use

You may use POP Remote to:

  • Access your own computers and devices
  • Access computers and devices you have explicit permission to access
  • Use AI features for legitimate automation tasks
  • Use voice features for hands-free control

6.2 Prohibited Use

You may NOT use POP Remote to:

  • Access computers or systems without authorization
  • Engage in any illegal activities or violate any laws
  • Transmit malware, viruses, or harmful code
  • Attempt to circumvent subscription limitations or quotas
  • Reverse engineer, decompile, or disassemble the App
  • Share or resell subscription accounts
  • Use AI features to generate, process, or distribute illegal content
  • Abuse or overload our AI services
  • Interfere with or disrupt the App or servers
  • Collect or harvest user information without consent
Important: Unauthorized access to computer systems is illegal and may result in criminal prosecution. You are solely responsible for ensuring you have permission to access any remote computers.

7. AI Features and Limitations

7.1 AI Task Automation

  • AI features are powered by Azure OpenAI and subject to their service availability
  • AI-generated actions may not always be accurate or complete
  • You are responsible for reviewing and approving AI actions before execution
  • We do not guarantee AI task success or accuracy
  • AI features require an active internet connection

7.2 Voice Control (Premium Only)

  • Voice recognition accuracy may vary based on accent, pronunciation, and environment
  • Voice features require microphone access permission
  • Voice recordings are processed in real-time and not permanently stored
  • Background noise may affect voice recognition accuracy

7.3 Content Responsibility

  • You are solely responsible for content you process using AI features
  • We do not monitor or control the content of your AI task descriptions or screenshots
  • You agree not to use AI features to process illegal, harmful, or offensive content
  • We reserve the right to suspend accounts that violate content policies

8. Intellectual Property

8.1 Our Rights

  • POP Remote and all related trademarks, logos, and service marks are our property
  • The App's source code, design, and functionality are protected by copyright and other intellectual property laws
  • You do not acquire any ownership rights by using the App

8.2 Your Content

  • You retain ownership of all content you create or access using the App
  • You grant us a limited license to process your AI task descriptions and screenshots solely to provide AI services
  • We do not claim ownership of your remote desktop sessions or connection credentials

8.3 Third-Party Content

  • FreeRDP library is used under the Apache 2.0 license
  • Azure OpenAI services are provided by Microsoft
  • Firebase services are provided by Google

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

POP REMOTE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of non-infringement
  • Warranties that the service will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy or reliability of AI features

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any indirect, incidental, special, or consequential damages
  • We are not liable for loss of data, profits, revenue, or business opportunities
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not liable for damages caused by your misuse of the App
  • We are not liable for unauthorized access to your remote computers

9.3 Remote Access Responsibility

  • You are solely responsible for the security of your remote computers
  • You are responsible for maintaining secure passwords and connection credentials
  • We are not liable for data loss, damage, or unauthorized access to your remote systems
  • You should maintain regular backups of important data

10. Indemnification

You agree to indemnify, defend, and hold harmless POP Remote and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • Unauthorized access to systems through your account
  • Content you process using AI features

11. Termination

11.1 Termination by You

  • You may stop using the App at any time
  • You may cancel subscriptions through Google Play Store
  • You may request account deletion by contacting support

11.2 Termination by Us

We may suspend or terminate your access if:

  • You violate these Terms
  • You engage in prohibited activities
  • We detect fraudulent or abusive behavior
  • Required by law or legal process
  • The service is discontinued

11.3 Effects of Termination

  • Your access to paid features will cease
  • Locally stored data will remain on your device
  • Account data may be deleted after termination
  • No refunds will be provided for early termination

12. Privacy

Your use of POP Remote is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data practices.

13. Changes to Terms

  • We may modify these Terms at any time
  • We will notify you of material changes via the App or email
  • Continued use after changes constitutes acceptance of new Terms
  • If you don't agree with changes, you must stop using the App

14. Governing Law and Disputes

14.1 Governing Law

These Terms are governed by the laws of the jurisdiction where POP Remote is registered, without regard to conflict of law principles.

14.2 Dispute Resolution

  • Any disputes shall first be attempted to resolve through good-faith negotiation
  • If negotiation fails, disputes may be submitted to mediation
  • Legal actions must be brought within one year of the claim arising

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and POP Remote regarding the App.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

15.5 Third-Party Services

The App integrates with third-party services (Azure OpenAI, Firebase, Google Play). Your use of these services is subject to their respective terms and policies.
